RERA Rules for Construction in Madhya Pradesh — What Buyers Must Know in 2026

erty in Indore or anywhere in Madhya Pradesh without checking RERA is one of the most common — and most expensive — mistakes homebuyers make.

RERA (Real Estate Regulation and Development Act) has been active in MP since May 2017. It exists for one reason: to protect you from builders who delay projects, change plans without permission, or disappear after taking your money. Here's everything that matters, explained simply.


What Is RERA MP and Why Does It Exist?



RERA MP is the state-level authority that regulates all real estate projects and agents in Madhya Pradesh. It operates through the official portal — rera.mp.gov.in

Before RERA, builders could:


  • Delay possession by years with zero penalty

  • Change your flat's layout after booking

  • Collect large advances without legal commitment

  • Sell the same unit to multiple buyers

RERA ended all of this — at least on paper, and increasingly in practice.



Which Projects Must Be RERA-Registered?



Not every construction project needs RERA registration. Here's the rule:

Mandatory registration if:


  • Land area exceeds 500 sq metres, OR

  • The project has more than 8 units


This applies to both new projects and ongoing ones that didn't have a Completion Certificate before May 2017.

Exempt projects:


  • Projects with a Completion Certificate before May 2017

  • Renovation or repair work with no new allotments

Bottom line: Any new apartment, housing society, or plotted development of meaningful size in Indore must be RERA-registered. If it isn't — walk away.



5 Key Rights RERA Gives You as a Buyer



1. Maximum 10% Advance Before Agreement A builder cannot ask for more than 10% of the property's cost before signing a formal Agreement for Sale. If a builder asks for 20–30% upfront before any paperwork — that's illegal under RERA.

2. No Plan Changes Without Your Consent Once you've booked, the builder cannot change the layout, design, or structural specifications without written consent from at least two-thirds of buyers.

3. Compensation for Delays If possession is delayed beyond the promised date, you have two options:

  • Exit the project and get a full refund with interest

  • Stay invested and receive monthly interest compensation until you get possession

4. Five-Year Defect Liability If any structural defect, workmanship issue, or quality problem shows up within 5 years of possession, the builder must fix it within 30 days at no cost to you. This is backed by law — not just a promise.

5. 70% of Your Money in Escrow Builders must deposit 70% of all funds collected from buyers into a dedicated project escrow account. This money can only be used for that specific project — preventing builders from diverting your money to other ventures.



Penalties Builders Face for Violating RERA MP Rules



This is what gives RERA actual teeth:

  • Not registering a project: Penalty up to 10% of total project cost

  • Providing false information: Up to 5% of project cost or imprisonment up to 3 years

  • Real estate agents misrepresenting a project: ₹10,000 per day, capped at 5% of project cost

  • Violating any RERA order: Fine up to 5% of project cost

These aren't just numbers on paper — MP RERA has been increasingly active in enforcement since 2024.



How to Check if a Project is RERA-Registered in 2 Minutes



Before booking anything in Indore, do this:

  1. Go to rera.mp.gov.in

  2. Click on Projects → Registered Projects

  3. Search by project name, developer name, or district

  4. Check the registration number, approved layout, possession date, and complaint history

If the project isn't listed — or the builder gives you a "registration is in process" excuse — do not pay anything until you see the registration number on the portal yourself.

How to File a RERA Complaint in MP



If a builder violates any commitment — delay, plan change, refund refusal — here's how to complain:

  1. Visit rera.mp.gov.in

  2. Go to the Complaint section

  3. Fill Form M (against promoter/builder) or Form N (against a RERA order)

  4. Upload documents — agreement, payment proofs, communication records

  5. Pay ₹1,000 complaint filing fee

  6. You'll receive a complaint number to track progress online

RERA adjudication is significantly faster than civil court — most cases are resolved within 60–90 days.


What RERA Does NOT Cover — Know the Limits


RERA is powerful, but it has boundaries:


  • It does not apply to individual homeowners building their own homes (self-construction)

  • It covers developers selling to buyers — not private construction contractors

  • Completed, ready-to-move properties with a Completion Certificate are exempt

  • Resale transactions between individuals are not covered by RERA
